1. Privacy<\/strong><\/h4>

Law no. 675 of 31 December 1996, containing provisions for the protection of people and other subjects with respect to the processing of personal data, was repealed by Legislative Decree no. 196 of 30 June 2003, which introduced the new Personal Data Protection Code. For this purpose, Fly Srl, with registered office in Via delle Fosse, 28 \u2013 31037 Loria (TV) as the independent Data Controller, is required to provide certain information regarding the use of personal data provided by the customer, or otherwise acquired in the context of the related activity.<\/p>

Source of personal data<\/b><\/p>

The personal data held by Fly srl are collected directly from customers or from third parties such as, for example, if data is acquired from external companies for the purposes of commercial information, market research, direct offers of products or services. For this last type of data, an information notice will be provided upon registration and not later than the first possible communication. In any case, all this data will be processed in compliance with the above-mentioned law and the confidentiality obligations that have always inspired the activity of our Company.<\/p>

The following data will be collected:
\u2013 user’s IP address;
\u2013 personal e-mail address;
\u2013 origin URL address<\/p>

A) It may also happen that in relation to specific operations or products requested by the Customer, Fly srl comes into possession of data that the law defines as ‘sensitive’, because from them it can be referred the possible membership of the customer to associations or information on his state of health. For their processing, the law requires a specific manifestation of consent.<\/p>

Processing purpose for which the data are intended<\/strong><\/p>

The personal data provided by the customer are processed within the normal activity of Fly srl and according to the following purposes:
\u2013 completion and support of access;
\u2013 to execute the transaction that the user is carrying out;
\u2013 to fulfil legal obligations;
\u2013 for operational and management needs.<\/p>

Data processing methods<\/strong><\/p>

In relation to the stated purposes, the processing of personal data takes place using manual, computer and telematic tools with logics strictly related to the same purposes and, however, to guarantee the security and confidentiality of the data. In any case, protection is also ensured when innovative channels such as telephone banking and multimedia kiosks are activated.
The data will be processed using appropriate tools to guarantee security and confidentiality and may also be carried out using automated tools to store, manage and transmit the data.<\/p>

Categories of subjects to whom the data may be communicated<\/b><\/p>

For the performance of most of its activities, Fly srl, as all big companies, also turns to external companies for technical and organizational reasons, in establishing and managing relationships with customers.<\/p>

These are those who carry out the following activities:<\/p>

\u2013 carrying out the work necessary to execute the instructions received from customers;<\/p>

\u2013 managing payment services, credit cards, tax collection and treasuries, etc.<\/p>

\u2013 fraud control and debt recovery;<\/p>

\u2013 accounting auditing.<\/p>

B) It follows that, without the consent of the interested party to communications to third parties and related processing, Fly srl will be able to perform only those operations that do not involve such communications.<\/p>

We warn that, pending such consent, if the customer still requests the execution of specific operations and services other than those listed above, the execution of the same by Fly srl must be understood as a provisional manifestation of consent limited to the processing related to the operations and services requested.<\/p>

All subjects belonging to the categories to which they can be communicated will use the data as ‘owners’ pursuant to Legislative Decree 196\/2003, in full autonomy, being unrelated to the original processing carried out at Fly srl.<\/p>

The personal data in possession of Fly srl may be communicated to other subjects, who may become aware of them, in the capacity of ‘responsible’ or ‘appointed’. The complete and constantly updated list of the offices and managers who, within Fly srl, process personal data is available at the respective Registered Office of the Company.<\/p>

Personal data will not be used to send advertising material, promotions and similar, since such activity must expressly provide for the consent of the data owner.<\/p>

The personal data processed by the Bank are not subject to disclosure.<\/p>

Rights under Article 7<\/strong><\/p>

Finally, Fly Srl informs that Article 7 of Legislative Decree 196\/2003 grants to the interested parties the exercise of specific rights. In particular, the interested party may obtain from the Data Controller a confirmation of the existence or not of their personal data and that such data be made available to them in an intelligible form. The interested party may also request to know the origin of the personal data, the purpose and method of processing; the logic applied in the event of processing carried out with the aid of electronic instruments; the identification details of the owner and the person responsible for obtaining the cancellation, transformation into anonymous form or blocking of data processed in violation of the law as well as the updating, rectification or, if there is interest, integration of the data; to oppose, for legitimate reasons, the processing of data concerning them also for the purposes of sending advertising material or direct sales.<\/p>

The rights in question may be exercised, also through a representative, by means of a request addressed to the person responsible appointed by letter. In exercising the rights, the interested party may confer in writing, delegation, or power of attorney to natural persons, entities, associations, or organizations. The interested party may also be assisted by a trusted person.<\/p>

1. Privacy<\/strong><\/h3>\nLa legge 31 dicembre 1996 n. 675, recante disposizioni per la tutela delle persone e di altri soggetti rispetto al trattamento dei dati personali, \u00e8 stata abrogata dal decreto legislativo 30 giugno 2003 n. 196, che ha introdotto il nuovo Codice in materia di protezione dei dati personali. A tal fine, Fly Srl, con sede legale in Via delle Fosse, 28 \u2013 31037 Loria (TV) in qualit\u00e0 di Titolare autonomo del trattamento, \u00e8 tenuta a fornire alcune informazioni riguardanti l’utilizzo dei dati personali forniti dal cliente, ovvero altrimenti acquisiti nell’ambito della rispettiva attivit\u00e0.\n\nFonte dei dati personali<\/b>\n\nI dati personali in possesso di Fly srl sono raccolti direttamente presso la clientela ovvero presso terzi come, ad esempio, nell’ipotesi in cui si acquisiscano dati da societ\u00e0 esterne a fini di informazioni commerciali, ricerche di mercato, offerte dirette di prodotti o servizi. Per quest’ultima tipologia di dati sar\u00e0 fornita un’informativa all’atto della loro registrazione e comunque non oltre la prima eventuale comunicazione. In ogni caso tutti questi dati verranno trattati nel rispetto della citata legge e degli obblighi di riservatezza cui si \u00e8 sempre ispirata l’attivit\u00e0 della nostra Societ\u00e0.\n\nVerranno raccolti i seguenti dati:\n\n– indirizzo IP dell’utente;\n– indirizzo e-mail personale;\n– indirizzo URL di provenienza.\n\nA) Pu\u00f2 accadere, inoltre, che in relazione a specifiche operazioni o prodotti richiesti dal Cliente, Fly srl venga in possesso di dati che la legge definisce come ‘sensibili’, perch\u00e9 da essi possono desumersi l’eventuale appartenenza del cliente ad associazioni o informazioni sul suo stato di salute. Per il loro trattamento la legge richiese una specifica manifestazione di consenso.\n\nFinalit\u00e0 del trattamento cui sono destinati i dati<\/b>\n\nI dati personali forniti dal cliente sono trattati nell’ambito della normale attivit\u00e0 di Fly srl e secondo le seguenti finalit\u00e0:\n\n– completamento e supporto dell’accesso;\n– per dare esecuzione alla transazione che l’utente sta compiendo;\n– per eseguire obblighi di legge;\n– per esigenze di tipo operativo e gestionale.\n\nModalit\u00e0 di trattamento dei dati<\/b>\n\nIn relazione alle indicate finalit\u00e0, il trattamento dei dati personali avviene mediante strumenti manuali, informatici e telematici con logiche strettamente correlate alle finalit\u00e0 stesse e, comunque, in modo da garantire la sicurezza e la riservatezza dei dati stessi. In ogni caso la protezione \u00e8 assicurata anche quando vengono attivati canali innovativi quali, ad esempio, banca telefonica e chioschi multimediali.\nIl trattamento dei dati avverr\u00e0 mediante strumenti idonei a garantirne la sicurezza e la riservatezza e potr\u00e0 essere effettuato anche attraverso strumenti automatizzati atti a memorizzare, gestire e trasmettere i dati stessi.\n\nCategorie di soggetti ai quali i dati possono essere comunicati<\/b>\n\nPer lo svolgimento della gran parte della sua attivit\u00e0, Fly srl, come tutte le grandi imprese, si rivolgono anche a societ\u00e0 esterne per ragioni di natura tecnica e organizzativa, nella instaurazione e gestione dei rapporti con la clientela.\nSi tratta, in modo particolare, di soggetti che svolgono le seguenti attivit\u00e0:\n\n– l’effettuazione di lavorazioni necessarie per l’esecuzione delle disposizioni ricevute dalla clientela;\n– la gestione di servizi di pagamento, di carte di credito, di esattorie e tesorerie, ecc.\n– il controllo delle frodi e il recupero dei crediti;\n– la revisione contabile.\n\nB) Ne segue che, senza il consenso dell’interessato alle comunicazioni a terzi ed ai relativi trattamenti, Fly srl potr\u00e0 eseguire solo quelle operazioni che non prevedono tali comunicazioni\n\nAvvertiamo che, in attesa di detto consenso, qualora il cliente richieda comunque l’esecuzione di specifiche operazioni e servizi diversi da quelli sopra prospettati, l’esecuzione degli stessi da parte di Fly srl deve intendersi come manifestazione provvisoria di consenso limitatamente ai trattamenti relativi alle operazioni e servizi richiesti.\n\nTutti i soggetti appartenenti alle categorie ai quali possono essere comunicati utilizzeranno i dati in qualit\u00e0 di ‘titolari’ ai sensi del decreto legislativo 196\/2003, in piena autonomia, essendo estranei all’originario trattamento effettuato presso Fly srl.\n\nI dati personali in possesso di Fly srl potranno essere comunicati ad altri soggetti, che possono venirne a conoscenza, in qualit\u00e0 di ‘responsabili’ o ‘incaricati’. L’elenco completo, e costantemente aggiornato, degli uffici e dei responsabili che, all’interno di Fly srl, trattano dati personali \u00e8 disponibile presso la rispettiva Sede Legale dell\u2019Azienda.\n\nI dati personali non verranno utilizzati per l’invio di materiale pubblicitario, promozioni e simili, poich\u00e9 tale attivit\u00e0 dovr\u00e0 prevedere espressamente il consenso del titolare dei dati\n\nI dati personali trattati dalla Banca non sono oggetto di diffusione.\n\nDiritti di cui all’art.7<\/b>\n\nFly Srl informa, infine, che l’art. 7 del decreto legislativo 196\/2003 conferisce agli interessati l’esercizio di specifici diritti. In particolare, l’interessato pu\u00f2 ottenere dal Titolare la conferma dell’esistenza o no di propri dati personali e che tali dati vengano messi a sua disposizione in forma intelligibile. L’interessato pu\u00f2 altres\u00ec chiedere di conoscere l’origine dei dati personali, la finalit\u00e0 e modalit\u00e0 del trattamento; la logica applicata in caso di trattamento effettuato con l’ausilio di strumenti elettronici; gli estremi identificativi del titolare e del responsabile di ottenere la cancellazione, la trasformazione in forma anonima o il blocco dei dati trattati in violazione di legge nonch\u00e9 l’aggiornamento, la rettificazione o, se vi \u00e8 interesse, l’integrazione dei dati; di opporsi, per motivi legittimi, al trattamento di dati che lo riguardano anche ai fini di invio di materiale pubblicitario o di vendita diretta.\n\nI diritti in oggetto potranno essere esercitati, anche per il tramite di un incaricato, mediante richiesta rivolta al responsabile nominato con lettera. Nell’esercizio dei diritti, l’interessato pu\u00f2 conferire per iscritto, delega o procura a persone fisiche, enti, associazioni od organismi.
